Layeredstylestudio (referred to as the "Site", "Store", "we", "us", or "our") respects the intellectual property rights of creators, designers, and copyright holders. Our platform specializes in providing premium collections of women's clothing tops. In strict accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512, we have established this dedicated DMCA Notice & Takedown Policy to address claims of unauthorized copyright usage on our Site.

If you are a copyright owner or an authorized agent thereof and believe that any visual asset, product description, image, or textile design hosted on our platform infringes upon your exclusive copyrights, you may submit a formal notification to our Designated Copyright Agent.

2. Requirements for a Valid DMCA Takedown Notice

To be processed effectively, your written DMCA Takedown Notice must be sent via email to support@layeredstylestudio.shop and contain substantially all of the following elements:

• Electronic or Physical Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed. If multiple works on our Site are covered by a single notification, you may provide a representative list of those works.
• Identification of the Infringing Material: Specific identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to allow us to locate the material. You must provide the exact URL(s) of the product listings for the women's tops in question.
• Contact Information: Information reasonably sufficient to permit Layeredstylestudio to contact you directly, including your legal name, physical mailing address, telephone number, and an active email address.
• Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Legal Disclaimer under DMCA Section 512(f): Please note that any person who knowingly and materially misrepresents that a product or activity is infringing may be subject to severe civil liability, including monetary damages, court costs, and attorneys' fees incurred by us or by the alleged infringer.

3. Immediate Response Protocol

Upon receipt of a valid, fully complete DMCA notice matching the criteria listed above, Layeredstylestudio will execute the following administrative actions:

• Removal of Content: We will remove or disable access to the contested material or product page within 24 to 48 hours.
• Internal Audit Hold: If the affected item is tied to any active, unfulfilled orders pending our standard daily 5:00 PM EST cut-off, those specific lines will be frozen until ownership is verified or the order is systematically canceled.
• Notification: We will take reasonable steps to promptly forward a copy of the notification to the merchant supplier, designer, or uploader who posted the material, allowing them the right to respond.

4. DMCA Counter-Notification Procedure

If your product listing was removed or disabled as a result of a DMCA notice, and you maintain that you possess the necessary copyright licenses, authorization, or that the removal was a result of a mistake or misidentification, you may file a formal written Counter-Notification.

Your Counter-Notification must be sent to support@layeredstylestudio.shop and must include:

• Your physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled, and the exact URL location at which the material appeared before it was removed.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed.
• Your legal name, address, and telephone number, along with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States, that you consent to the jurisdiction of the Federal District Court in Florida), and that you will accept service of process from the person who provided the original DMCA notification.

Next Steps in the Counter-Notice Process

If Layeredstylestudio receives a valid Counter-Notification, we will forward a copy to the original complaining party. The original copyright owner then has 10 to 14 business days to respond with proof that they have filed a formal legal action seeking a court order to restrain the uploader from engaging in the infringing activity. If no such legal action is filed within that window, we reserve the right to reinstate the disabled product page or material.

5. Repeat Infringer Policy

In accordance with DMCA regulations and our internal platform security policies, Layeredstylestudio enforces a strict repeat infringer policy. We reserve the absolute right to permanently terminate the supplier contracts, designer privileges, or customer accounts of any individual or entity found to repeatedly or intentionally violate the intellectual property rights of others.

6. Financial and Operational Alignment

If a product page is permanently taken down due to a verified copyright infringement, any customer orders containing that specific top that have not yet cleared our 1-day handling window will be canceled.
In keeping with our consumer protection guidelines, a 100% full refund will be initiated back to the buyer's original payment method (PayPal or Venmo) within our strict 12-day refund processing timeline at absolutely no fee ($0.00) to the customer.
